How to Start a Small Business in Alabama

Formation through probate or online, Alabama unique business privilege tax, sales tax registration, and the licenses that apply to your trade.

HBy Hebner Solutions · Updated October 14, 2026

Alabama startup path has two details that are genuinely different from most states: LLC formation traditionally runs through your county probate judge, and the state charges an annual business privilege tax that starts in your very first year. Here is the realistic sequence.

Step 1: Form your entity

Alabama LLCs and corporations are formed by filing a Certificate of Formation, historically with the probate judge of your county and recorded with the Secretary of State — total filing costs commonly land around $200. The Secretary of State also offers online filing for many entity types.

Sole proprietors operating under their own name need no formation filing; a trade name can be registered with the Secretary of State.

Step 2: The business privilege tax and MyAlabamaTaxes

Every Alabama LLC and corporation pays an annual business privilege tax based on net worth, with a $100 minimum, from the first year onward. You file the return with the Alabama Department of Revenue through MyAlabamaTaxes (myalabamataxes.alabama.gov) each spring for the prior year.

New owners routinely miss this because no invoice ever arrives — the obligation exists whether or not you earned anything. Put the return date on your calendar at formation.

Step 3: Sales tax — state and local

Register for sales and use tax with the Alabama Department of Revenue. The state rate is 4%, but Alabama local sales taxes are among the highest in the nation, with combined rates commonly 8% to 10% and varying by city and county. A further Alabama quirk: many cities administer their own local sales tax separately from the state, so you may need two registrations depending on where you do business.

Step 4: Licensing

  • Home builders and remodelers: licensed through the Alabama Home Builders Licensure Board above minor-job thresholds.
  • Electricians and other trades: often licensed at the city level in Alabama rather than the state — Birmingham, Huntsville, Mobile, and Montgomery each have their own requirements.
  • Real estate, cosmetology, and other professions: through their respective state boards.

What launching in Alabama typically costs

  • LLC formation: commonly around $200
  • Business privilege tax: $100 minimum per year
  • Sales tax registrations: free
  • General liability insurance: commonly $50 to $150 per month for a solo service business
